These terms are the agreement between you and Smart Scope Inc., the makers of Smart Service, 495 Metro Place South, Dublin, Ohio 43017 ("Smart Scope," "we," "us"). They cover the Smart Scope iOS app, trysmartscope.com, and related services — including digital forms on the web, EyesOn, and Command OPS. By using any of them, you agree to these terms. If you're using Smart Scope for a company, you're agreeing on that company's behalf.
The 45-day free trial
Every new account gets 45 days of full access, free. No credit card is required to start, which means there is nothing to auto-bill: when the trial ends, you are never charged automatically. Your account simply becomes view-only — your data stays put, you can still see and export it, and subscribing later reactivates everything instantly.
Subscription, billing, and cancellation
After the trial, Smart Scope is a subscription purchased through the Apple App Store as an in-app purchase — currently $69.99 per month, or $599.99 per year. There is no long-term contract and no cancellation fee. Billing, renewal, and cancellation are handled through your Apple account: subscriptions renew until you cancel in your App Store settings, cancellation takes effect at the end of the current billing period, and refund requests for App Store purchases are made to Apple under Apple's refund policies. When your subscription ends, your account becomes view-only exactly as it does after a trial — nothing is deleted.
We may change subscription pricing for future billing periods; if we do, you'll be notified in advance through the App Store's standard process and can cancel before the new price takes effect.
Your AI keys
Smart Scope's AI features run on API keys you connect and own — an Anthropic (Claude) key, and optionally an OpenAI key for photo generation. Your use of those providers is governed by your own agreements with them, and their usage fees are billed by them directly to you and are separate from your Smart Scope subscription. Keeping your keys funded, valid, and secure is your responsibility; AI features won't function without a working key, and that isn't a defect in the service.
AI-generated content is a draft, not a decision
Smart Scope uses AI to draft estimates, scopes of work, line items, prices, research reports, forms, messages, and similar content. AI output can be wrong — it can mis-hear, mis-count, or mis-price. That's why nothing leaves the app without you: you review and approve every estimate before it's sent. You are solely responsible for the accuracy of what you send to your customers, for your own pricing and margins, and for your business decisions. Intelligence reports (competitive and market research) are decision-support estimates built from public sources and modeling — they're labeled as such and aren't a guarantee of market outcomes.
EyesOn and recordings
EyesOn provides live video, audio, and recording between members of your team. You're responsible for using it lawfully — including notifying participants and obtaining any consent your state's recording laws require, and respecting your customers' privacy and property. Recordings are stored in your account as your data.
Your customers and your forms
Digital forms, estimates, and payment requests you send reach real people. You're responsible for having the right to contact them, for the accuracy of what you send, and for complying with laws that apply to your outreach — including e-signature disclosures and anti-spam laws for any bulk email you send through your own connected accounts.
Your data is yours
You own the business data you put into Smart Scope — your customers, estimates, price book, photos, recordings, and records. You grant us only the limited license we need to host, process, back up, and display that data in order to run the service for you. You can export your data at any time from the app. After a trial or subscription ends, your data remains in view-only mode rather than being deleted; if you want it permanently deleted, email hello@trysmartscope.com and we'll do it. We don't sell your data or use it to train AI models.
Your account and acceptable use
Keep your login credentials secure — you're responsible for activity under your account. Use Smart Scope only for lawful business purposes. Don't attempt to break, probe, or overload the service; don't upload malicious code; don't use the service to send unlawful communications; don't scrape or resell the service; and don't use someone else's account without permission. We can suspend accounts that violate these rules, but we'll aim to warn you first for anything short of serious abuse.
Our stuff
Smart Scope — the app, site, design, and brand — belongs to Smart Scope Inc. and its licensors. Your subscription gives you the right to use it, not to copy or resell it. Feedback you send us can be used to improve the product without obligation.
Third-party services
Smart Scope connects to services we don't control — Apple, Anthropic, Smart Service, Quo, calendar providers, and others. Their availability, terms, and pricing are theirs; an outage or change on their side isn't a breach of these terms by us.
No warranties
Smart Scope is provided "as is" and "as available." We work hard to keep it fast, accurate, and online, but we can't promise it will be uninterrupted or error-free, and we disclaim implied warranties like merchantability and fitness for a particular purpose to the extent the law allows.
Limitation of liability
To the maximum extent the law allows, Smart Scope Inc. won't be liable for indirect, incidental, special, or consequential damages — including lost profits, lost jobs or bids, or lost data — and our total liability for any claim relating to the service is capped at the amount you paid us in the twelve months before the claim. Some states don't allow certain limitations, so parts of this section may not apply to you.
Indemnification
If your use of Smart Scope — including the estimates you send, the recordings you make, or the communications you dispatch — leads to a claim against us by someone else, you agree to defend and hold us harmless from that claim.
Apple App Store
The app is distributed through Apple's App Store, and Apple's standard end-user license terms apply to the download itself. Apple isn't a party to these terms, has no responsibility for the app or its content, and has no warranty or support obligations for it beyond any refund Apple's policies provide. Apple is a third-party beneficiary of this section and may enforce it.
Ending or changing the service
You can stop using Smart Scope any time. We may modify features as the product evolves — the What's New page is the running record — and if we ever discontinued the service, we would give you reasonable notice and time to export your data.
Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules, and any dispute that ends up in court belongs in the state or federal courts located in Franklin County, Ohio. Both sides waive any objection to that venue.
Changes to these terms
If we change these terms, we'll update the date at the top and, for significant changes, notify you in the app or by email before they take effect. Continuing to use Smart Scope after that means you accept the updated terms.
